Anomaly in computation of Minimum Wage

As against the Minimum Wage decided to be Rs. 18000/- by the Govt. w.e.f. 01.01.2016, the Staff-Side has said that this should be not less than Rs. 26,000/-and the multiplication factor ought to have been 3.714 and not 2.57. They have further asked for the pay matrix to be changed. Objecting to the methodology adopted by the 7th CPC in computing the Minimum Wage, they have given a number of reasons like the retail prices of the commodities quoted by the Labour Bureau being irrational, adoption of the 12 monthly average of the retail price being contents to the Dr. Avkrovd formula, the website of the Agriculture Ministry giving the retail prices of commodities forming the basis of computation of minimum wage provides a different picture, so on and so forth.
However, when one compares this item with the three situations given in DoPT’s OM.No.11/2/2016-JCA dated 16th August, 2016 and 20th February, 2017, it does not appear that this satisfies any of them to be treated as an anomaly.
The 7th CPC categorically stated that the principle adopted for minimum wage determination is Dr. Aykhoyd formula. But deviated from the same while actual computation was made. It becomes an anomaly under clause 1(a) of the definition (see OM dated 16.08.2016).

There has been huge confusion among the Central Government employees regarding the minimum pay hike. Although, since last two months government has been continuously promising the employees to raise the fitment factor and salaries as per the recommendations of the 7th Central Pay Commission(CPC), different media reports have suggested that there may not be any hike in the minimum basic pay of the Central Government employees.

जबलपुर हाईकोर्ट ने कहा है कि नियुक्ति के समय यदि किसी ने आरक्षण का लाभ ले लिया है, तो वह पदोन्नति के समय दोबारा लाभ नहीं ले सकते। हाई कोर्ट चीफ जस्टिस हेमंत गुप्ता और जस्टिस विजय कुमार शुक्ला की बेंच ने यह बात सागर में एडीशनल सिविल जज के पद पर पदस्थ पदमा जाटव की याचिका खारिज करते हुए कही।

इस याचिका में मप्र उच्च न्यायिक सेवा (जिला जज-प्रवेश स्तर) में सिविल जज सीनियर डिवीजन परीक्षा 2017 में आरक्षण का लाभ न दिए जाने को चुनौती दी गई थी। आवेदक का कहना था कि हाईकोर्ट के प्रिंसिपल रजिस्ट्रार (परीक्षा) ने 61 पदों को पदोन्नति से भरने 24 मार्च 2017 को ‌एक विज्ञापन जारी किया था। इसकी लिखित परीक्षा में याचिकाकर्ता भी शामिल हुईं, लेकिन एक अंक कम होने से वो इंटरव्यू से वंचित हो गई। आवेदक का दावा था कि यदि उसे आरक्षण का लाभ दिया जाता तो निश्चित रूप से उसे पदोन्नति मिलती। इस पर यह याचिका दायर करके चयन प्रक्रिया को कटघरे में रखा गया।

मामले पर हुई सुनवाई के दौरान राज्य सरकार की ओर से उपमहाधिवक्ता संजय द्विवेदी ने पक्ष रखा। सुनवाई के बाद बेंच ने अपने फैसले में कहा- ‘याचिकाकर्ता अनुसूचित जाति वर्ग से है और सिविल जज पर उनकी नियुक्ति अजा वर्ग के लिए आरक्षित सीट पर हुई थी। अब जब एक बार याचिकाकर्ता ने नियुक्ति के समय आरक्षण का लाभ ले लिया, तो ऐसे उम्मीदवार को दूसरी स्टेज पर आरक्षण का फिर से नहीं मिल सकता।’

याचिकाकर्ता की ओर से दी गईं दलीलों को नकारते हुई युगलपीठ ने कहा कि इन पदों को सीमित प्रतियोगी परीक्षा के जरिए भरा जाना है, तो कानून में दी गई पदोन्नति प्रक्रिया के मुताबिक है। इस मत के साथ युगलपीठ ने मामला हस्तक्षेप योग्य न पाते हुए याचिका खारिज कर दी।

HYDERABAD: Railway Board chairman Ashwani Lohani on Wednesday called upon the officials of the state-run transporter to accord utmost priority to safety, punctuality and mobility.

These three aspects - safety, punctuality and mobility - reflect the competence of Railways, he said.

Lohani was addressing a meeting after reviewing the performance of the South Central Railway (SCR) Zone at Rail Nilayam here.

"There should be no unsafe condition on Railways," an SCR release quoted Lohani as saying at the meeting.

अक्‍टूबर, 2017 का औद्योगिक कामगारों के लिए उपभोक्ता मूल्य सूचकांक

अक्‍टूबर, 2017 में औद्योगिक कामगारों के लिए अखिल भारतीय उपभोक्ता मूल्य सूचकांक (सीपीआई-आईडब्ल्यू) दो अंक बढ़कर 287 हो गया। 1-मासिक प्रतिशत बदलाव के आधार पर पिछले वर्ष की इसी अवधि की बढ़ोतरी (+) 0.36 की की प्रतिशत तुलना में यह सितम्‍बर, 2017 और अक्‍टूबर, 2017 के बीच (+) 0.70 प्रतिशत बढ़ा। मौजूदा सूचकांक में अधिकतम दबाव खाद्य समूह के कारण आया, जो कुल परिवर्तन में (+) 1.94 प्रतिशत था। जिंस के स्तर पर चावल, दूध (भैंस), प्‍याज, करेला, बैंगन, पत्‍तागोभी, फूलगोभी, गाजर, लौंकी, फ्रेंचबीन, धनियापत्‍ती, भिंडी, परवल, आलू, टमाटर, तरोई, सिगरेट, रसोई गैस, डॉक्‍टरों की फीस, सिनेमा शुल्‍क, मरम्‍मत शुल्‍क, दर्जी का शुल्‍क इत्‍यादि के अधिक रहने के कारण यह बढ़ोतरी हुई है। हालांकि अरहर दाल, ताजा मछली, पोल्‍ट्री (चिकन), हरी मिर्च, मटर, सेब, केला, संतरा, पेट्रोल इत्‍यादि की कीमतें कम रहने के कारण इस बढ़ोतरी पर रोक लगी है।
अक्‍टूबर, 2017 के लिए मासिक सीपीआई-आईडब्लयू के संदर्भ में साल-दर-साल मुद्रास्फीति 3.24 प्रतिशत रही, जबकि पिछले महीने यह 2.89 प्रतिशत थी और पिछले वर्ष की सामान अवधि में यह आंकड़ा 3.35 प्रतिशत था। इसी तरह खाद्य मुद्रा स्फीति 2.26 प्रतिशत रही, जबकि पिछले महीने यह 1.30 प्रतिशत थी और पिछले वर्ष की सामान अवधि के दौरान यह 2.99 प्रतिशत थी।

श्री सुनील कुमार चौरसिया, आईओएफएस को 1 दिसंबर, 2017 से नए महानिदेशक, आयुध निर्माणी (डीजीओएफ) एवं अध्‍यक्ष, आयुध निर्माणी बोर्ड (ओएफडी) के रूप में नियुक्‍त किया गया है। इससे पहले वह सदस्‍य, आयुध निर्माणी थे तथा सामग्री एवं कलपुर्जा विभाग का कार्यभार देख रहे थे।

जबलपुर से यांत्रिक इंजीनियरिंग में स्‍नातक की डिग्री लेने के पश्‍चात उन्‍होंने आईआईटी खड़गपुर से एम टेक की डिग्री ली और श्री चौरसिया ने 1981 में भारतीय आयुध निर्माणी सेवा में पर्दापण किया।

रक्षा मंत्रालय का दिव्यांग पूर्व सैनिकों, युद्ध विधवाओं और शहीदों के बच्चों के कल्याण के लिए योगदान में जनता को प्रोत्साहित करने हेतु सशस्त्र सेना झंडा दिवस मनाने का विशेष अभियान।

1949 से शहीदों और देश के सम्मान की रक्षा के लिए हमारी सीमाओं पर लडने वाले सैनिकों के सम्मान हेतु पूरे देश में हर साल 7 दिसम्बर को सशस्त्र सेना झंडा दिवस मनाया जाता है। ऐसे दिव्यांग पूर्व सैनिकों, युद्ध विधवाओं, शहीदों के बच्चों और अन्य ऐसे लाभार्थियों को मदद करने के लिए सशस्त्र बल झंडा दिवस कोष की स्थापना 1993 में की गई थी जिन्हें हमारी देखभाल और सहायता की आवश्यकता है।

सैन्य कर्मियों की तलाकशुदा बेटियों को भी परिवारिक पेंशन की सुविधा मिलेगी, वैसी स्थिति में भी जब तलाक की अर्जी माता-पिता के जीवनकाल में ही दाखिल की गई हो

सितंबर 2015 में जारी रक्षा मंत्रालय के एक पत्र के अनुसार, वर्तमान में केवल उन्ही बच्चों को परिवारिक-पेंशन का पात्र माना जाता है जो माता-पिता पर आश्रित हैं और सरकारी कर्मचारी या उसकी पत्नी/पति के मृत्यु के समय अन्य शर्ते को पूरा करते हैं। इसी संदर्भ में, तलाकशुदा बेटियाँ परिवारिक-पेंशन के योग्य हैं जो अन्य शर्ते पूरा करती हों यदि सक्षम न्यायालय ने उनके माता व पिता में से किसी एक के जीवन काल में तलाक का निर्णय दिया हो।

The Union Cabinet chaired by the Prime Minister Narendra Modi has approved the revision in the salaries, gratuity, allowances, pension etc. of the Judges of the Supreme Court and the High Courts and retired Judges of Supreme Court and High Courts. It follows the implementation of recommendations of the 7th Central Pay Commission in respect of Civil Servants.

Subject: Cadre Restructuring of Group ‘C’ employees in Department of Posts.

Sir/Madam,
The Cadre Restructuring Order of Group ‘C’ employees was issued vide this office letter of even number dated 27.05.2016. Later on, some Circles requested for further clarification, which were issued vide this office letter of even number dated 11.11.2016. However, Circles still faced with problems while implementing the orders.

2. Issues like norms for allotment of number of LSG posts, instructions for identification of surplus LSG posts other than C and B class POs, identification of HSG-I (NFG) posts, divisionalisation of LSG Cadre, relaxation of minimum qualifying service for promotion to HSG-II and HSG-I and date of effect of the orders etc. needed further clarification.

3. Therefore, on representation of various Staff Unions to the Secretary (Posts) regarding the issues arising out of implementation of Cadre Restructuring, a Committee was constituted vide Office Order of even number dated 09.06.2017, under the Chairmanship of Sh. Charles Lobo, CPMG Karnataka Circle and DDG (Estt), PMG (M&BD), Chennai and PMG, Pune Region as its members to examine all such issues. The Committee after thorough consultation, including one with the staff representatives, submitted its report on 22.09.2017.

4. The recommendations of the Committee, as accepted by the Competent Authority, are as under:-

4.1 Uniform Guidelines for identifying the surplus LSG posts other than Single Handed and Double Handed (C and B Class) Post Offices:

(i) Treasurer posts should not be identified for upgradation as Treasurer posts are PA posts with special cash handlingallowance.

(ii) The posts of System Administrator, Marketing Executive, DO (PLI) etc. are not cadre specific posts. Therefore, any suitable official can be deployed against these posts.

(iii) As per the Recruitment Rules, the PAs of Foreign Posts are recruited separately and trained for Foreign Post. But on promotion to LSG they are transferable to other LSG posts on postal side and vice versa. Hence extending the benefit of cadre restructuring to officials of Foreign Post in LSG and above cadres is in order as far as foreign post is concerned. Only Mumbai Foreign Post is treated as separate Foreign Post unit.

(iv) The present cadre restructuring order is not applicable to RLO. Hence RLO staff should not be included in cadre restructuring.

(v) After upgrading C and 8 class SPM posts to LSG remaining LSG posts allotted to the Circle can be utilized as per functional requirement. The officials occupying these restructured LSG posts will have either or both supervisory and operative responsibilities as per allocation ofwork by competent authority.

(vi) The SPMs posts of C and B class post offices are upgraded to LSG without following the LSG norm of 5:1. Therefore, it is not practicable to prescribe the norm for other restructured LSG posts. Number of posts to be created in each office will be as per functional requirement.

(vii) Accountants are Postal Assistants only who have passed the PO & RMS Accountants examination. They are eligible for promotion as per Recruitment Rules. Norm based LSG accountants posts can be upgraded to HSG II within the number of posts allotted to the circle.

(viii) The post of Accountant in Divisional Office can be upgraded to LSG. If there is more than one post of Accountant in HPOs, some may be upgraded to LSG while leaving some others for time scale Accountants.

(ix) More Posts may be identified in bigger offices like HPOs and MDGs. It is not possible to specify the number of posts as the staff strength and functional requirements vary from office to office. Thereafter PM Grade-III/HSG I pre restructured HPOs may be given preference for creation of posts. PM Grade II/HSG II HPOs, PM Grade III/HSG I MDG, PM Grade II/ HSG II SO/MDG, (all pre restructured) may be preferred for creation of posts in that order based on functional requirement. Circles should ensure that the posts are not disproportionately concentrated in a few offices/cities.

(x) In charge CPC, Foreign post (except Mumbai Foreign Post), PSD and CSD or other offices can be considered for upgradation of posts to LSG.

(xi) If Circles are left with surplus LSG posts, then limited number of posts in Divisional Office and important delivery offices may be identified for upgradation.

(xii) All the posts of SPMs in B and C class offices should be upgraded to LSG and all LSG norm based and A class offices should be upgraded to HSG II as a result of the implementation of the orders.

4.2 Identification of NFG posts in HSG I: Only 10 percent of HSG I posts i.e. 235 posts have been approved for NFG scale. Therefore it is not possible to promote all HSG I officials who are completing 2 years of service in HSG I. Although there is need to identify these posts for promotion from HSG l, in order to avoid inconvenience to staff in the initial stage and purely as a temporary measure, the officials can be given NFG on the basis of seniority wherever they are posted in HSG l by upgrading the HSG I post to NFG and simultaneously downgrading the NFC position to HSG-I elsewhere. In due course of time the posts need to be identified.

4.3 LSG Cadre: The Committee examined the issue of Divisionalization of LSG Cadre. The Committee observed that there are some mofussil Divisions which have more B and C class offices now upgraded to LSG but are having very less HSG II and HSG I offices. On the other hand there will be city Divisions where the number of B and C class post offices now upgraded to LSG are very less. Divisionalization will provide less opportunity for staff of these divisions to get LSG promotion and in turn affect their HSG promotions. The Divisionalization will create promotional disparity between employees in different Divisions. Therefore, the Committee’s recommendation not to Divisionalize LSG cadre has been accepted. It will remain a circle cadre. However, for better management of transfer and postings and to minimize inconvenience to the staff, Circle would allot officials to Regions for further allotment to Divisions, which in turn shall issue the posting orders in case. of the LSG officials and rotational transfer orders thereafter till such time that they remain allotted to that Division by the Region. At any time the Circle or Region may allot these LSG officials to any other Region or Division respectively.

4.4 Revision of Leave Reserve (LR) strength consequent upon upgradation to LSG. It has been observed that consequent on cadre restructuring the LR strength would be considerably reduced. The Committee observed that the postmaster in restructured LSG grade working in B and C class offices have to do operative work. Similarly restructured LSG PAs in other post offices have to do operative/supervisory work. Therefore, the Committee’s recommendation that considering the PA strength and the restructured LSG strength for calculation of LR strength will be in order, has been accepted.

4.5 Date of Effect of the Orders and completion of restructuring: For the sake of uniformity, the promotion will be effective from the date of issue of the original order dated 27.05.2016 as per existing instructions on the subject. It will be applicable to all eligible officials including those who were in service but now retired.

5. The rationalization of posts, as recommended by the Committee and accepted by the Competent Authority, is attached as Annexure-I.

6. In view of the above, all the Circles are requested to take immediate necessary action to implement the Cadre Restructuring of Group ‘C’ employees, keeping in view the above instructions without any further delay. All attempts should be made to complete the exercise of conducting DPCs by 31.12.2017 and the whole exercise, including transfer/posting Orders, must be completed by 31.01.2018.

कांग्रेस के राज्यसभा सदस्य मोतीलाल वोरा ने रेलवे मंत्रालय से एक मासूम सा सवाल पूछा. सवाल यह था कि रेलवे ने पिछले तीन साल में कितने नए कर्मचारियों को नौकरी पर रखा और इस दौरान कितने कर्मचारी रिटायर हो गए.

सरकार ने 11 अगस्त, 2017 को राज्यसभा में जानकारी दी कि पिछले तीन साल में रेलवे में 1,15,003 कर्मचारियों और अफसरों को नौकरी पर रखा और इसी दौरान 1,79,322 कर्मचारी और अफसर रिटायर हो गए.

UP Traffic Cops To Don Blue Trousers From Dec 1

Lucknow: Come December 1, Uttar Pradesh traffic police will once again don blue trousers instead of the existing khaki – a light shade of yellow and brown.

UP traffic cops will wear white shirts and blue trousers from December 1.

“At a meeting of the DGP, it was unanimously decided by officers to change the colour of khaki trousers to blue from December 1. It has been done to give the traffic police a separate identify,” a senior official said here.

Sir/Madam,

In continuation to KVS circular of even number dated 03.08.2017 I am directed to refer to MHRD’s letter No.F.3-14/2017-UT.2 dated 31.10.2017 and to convey the approval of the Govt. of India for implementation of revised allowances based on the recommendations of the 7th CPC in KVS. The MHRD has agreed for additional funds to the extent of implementation of revised allowances in terms of Department of Expenditure (MoF) O.M F. No. 1/1/2016-E.III(A) dated 26.07.2017.

It is further clarified that Department of Expenditure (MoF) O.M.F.No. 1/1/2016- E.III(A) dated 13.01.2017 is applicable only in case of pay scales and not in case of pension as such additional funds for the purpose of pension may not be allowed while implementing the revised pay scale and allowances in KVS.
Copies of Department of Expenditure (MoF) OM’s dated 13.01.2017 and 26.07.2017 ibid are enclosed.
