Consumer Price Index for Industrial Workers (CPI-IW) – December, 2015

The All-India CPI-IW for December, 2015 decreased by I point and pegged at 269 (two hundred and sixty nine). On 1-month percentage change, it decreased by (-) 0.37 per cent between November and December, 2015 which was static between the same two months a year ago.

CBI registers case against senior railway engineer

CBI has registered a corruption case against a Deputy Chief Engineer of the railways for allegedly amassing assets of Rs 64.22 lakhs disproportionate to his known sources of income. 

The agency has filed the FIR against A Satish, the then Senior Divisional Engineer posted at Guntu and at present working as Dy. Chief Engineer (Design) in Guwahati, for alleged possession of disproportionate assets to the tune of Rs 64.22 lakhs, it said today.

In a major reshuffle in the IPS cadre in West Bengal, Additional Director General of Police, CID, Rajeev Kumar, has been appointed as new Kolkata Police Commissioner replacing Surajit Kar Purakayastha. 

A 1989 batch IPS officer, Kumar had earlier worked as Commissioner of Police, Bidhannagar Police Commissionerate and as Special Task Force (STF) chief under Kolkata Police.

'BSNL employees may not get to see 7th pay commission hike, till company turns profitable'

New Delhi: It is that time of the year that the buzz around employees' salary increments starts building up. But employees of the PSU telecommunications major Bharta Sanchar Nigam Limited (BSNL) got a dampener on Thursday.

BSNL Chairman and Managing Director Anupam Shrivastava announced that the employees of the company will not get the benefit of the salary hike as announced in the 7th pay commission if the company runs in loss in 2015-16.

Though, BSNL had reported an operating profit of Rs 672 crore in 2014-15, it had been posting losses since the previous four years.

The company had an employee strength of 2,25 lakh as on March 2015.

Urgent Need to Rectify Anomalies in OROP
in Govt notification dated 7 Nov 15

Dear Shri Manohar Parrikar ji

Please refer to Govt executive letter dated 26 Feb 14, press release dated 5 Sep 15, Govt notification dated 7 Nov 15 and 14 Dec 15. Please also refer to the statement made by MOS Defense Sh Rao Inderjit Singh in Parliament on 2 Dec in reply to question asked by Sh Rajeev Chandrashekhar regarding implementation of OROP. (All attached)

One Rank One Pension was approved by UPA Govt in budget dated 17 Feb 14 and then by NDA Govt in their budget dated 10 Jun 14. UPA Government issued an executive order dated 26 Feb 14 for the implementation of OROP dues to veterans at the earliest. This was never implemented by the MOD nor a demand note was ever raised. The approved definition of OROP by two Governments is given below.

One Rank One Pension (OROP) implies that uniform pension be paid to the Armed Forces Personnel retiring in the same rankwith the same length of service irrespective of their date of retirement and any future enhancement in the rates of pension to beautomatically passed on to the past pensioners. This implies bridging the gap between the rate of pension of the current pensioners and the past pensioners, and also future enhancements in the rate of pension to be automatically passed on to the past pensioners.

OROP implies that a senior rank soldier should never draw pension less than his junior rank soldier. This cardinal principle is the soul of OROP and must never be violated.

Government issued a notification on 7 Nov 15 for implementing OROP. Government reiterated above-mentioned definition of OROP in the letter but introduced some conditions in the notification that completely destroy the definition approved by two parliaments. These conditions have created four anomalies which completely violates the definition and thereby, the soul of OROP. These anomalies are discussed in detail in succeeding paragraphs.

1) Fixation of Pension on calendar year of 2013 instead of FY of 2014: Fixation of pension as per calendar year 2013 would result in past retirees getting less pension of one increment than the soldier retiring today. This will result in past retirees drawing lesser pensions than present retirees. This will completely destroy definition of OROP approved by two Parliaments and will also result in loss of one increment across the board for past pensioners in perpetuity.

2) Fixation of pension as mean of Min and Max pension: Fixing pension as mean of Min and Max pension of 2013 would result in more anomalies wherein same ranks with same length of service will draw two or more different pensions thus violating the very principle of OROP. This issue was discussed with RM in various meetings and after due deliberations it was decided that accepting highest pension of each rank in the year would meet the requirement as base of pension.

3) Payment wef 1st Jul 14 instead of 1st Apr 14: OROP has been approved in budget of 2014-15 by two parliaments. As per norms of Government, all proposals approved in budget are applicable from 1st April of that FY. In the case of OROP, the Govt had issued specific orders to its applicability wef 1st April 14. Hence implementation date for OROP from 1st July will be against the Parliament approval. Changing the date would result in loss of 3 months emoluments for OROP across the board. However, if OROP implementation date is to be kept as 1st July, then the base pension should also be accepted as per the PPOs of July 2014.
4) Pension Equalisation every five year: Pension equalisation every five year will result in a senior rank soldier drawing lesser pension than a junior rank soldier for five years thus OROP definition will be violated for five years. This will also result in permanent violation of definition as fresh cases will come up every year.

These anomalies will result in lesser pensions to widows, soldiers, NCOs and JCOs than what will be due to them on approval of OROP. This will result in veterans not getting OROP as per approved definition and will create large discontentment across all ranks.

There is a need to have a relook at the pensions of Hon Nb Subedars, Majors and Lt Cols.

a) Some Havildars are granted rank of Hon Naib Subedar in view of their exemplary service. These soldiers are not granted pension of Naib Subedar thus making the Hon rank just ceremonial. It is requested that Hon Naib Subedars should get pension of a Naib Subedar rather than that of a Havildar. Similarly, this must be accepted as a principle and it should be applicable to all Hon ranks in case of NCOs and JCOs.

b) There are only a few Majors as veterans. Moreover no officer is retiring in Major rank now. In the past, officers were promoted to Major rank after completing 13 yrs of service whereas present officers are getting promotion of Lt Col in 13 yrs. It will be justified to grant all pensioners of the rank of Major, minimum pension of Lt Col as they cannot be compared to present retirees as officers are not retiring as Majors any more. Number of such affected officers is not more than 800 and will not cause heavy burden to Govt.

c) Similarly, all pre-2004 retiree Lt Cols should get the minimum pension of full Col. Presently all officers retire in the rank of Colonel hence all Lt Col equivalents should be granted min pension of Colonels.

In view of above you are requested to rectify these anomalies and issue addendum to notification issued on 7 Nov 15 for implementation of OROP. We strongly believe that there will be no requirement of judicial committee for attending to anomalies creeping up in implementation of OROP. Grant of increase in pension in case of honorary ranks and Majors and Lt Col must also be approved as a good will gesture.

This letter is being signed by three major organizations with the approval of more than 200 organizations. List of such organizations is attached.

PF panel recommends 8.95 per cent rate


The proposed rate, the highest in five years,may face resistance from the union finance ministry which is looking to cut interest rates

The Finance and Investment Panel of the Employees’ Provident Fund Organisation (EPFO) board has proposed an 8.95 per cent rate of return on retirement savings under its watch for 2015-16 as it is ‘feasible,’ according to people in the know-how.
The proposed rate, the highest in five years, may face resistance from the Finance Ministry which is looking to cut interest rates on small savings instruments. At present, EPFO gives 8.75 per cent as the rate of return. This would make investment in EPFO more attractive than most savings alternatives such as General Provident Fund, Public Provident Fund, Special Deposit Scheme and National Savings Certificates which offer lower rate of return.

The central board of trustees of EPFO, chaired by Union Labour Minister, Bandaru Dattatreya, is likely to take a final call on fixing the interest rates in February.

“The Finance Investment Audit Committee (FIAC) recommended giving up to nine per cent as interest rates for 2015-16 to the EPFO board which will meet early next month,” said an FIAC member, on condition of anonymity, referring to the decision at its meeting on Monday.

Revision of pension in respect of Pre-2006 Commissioned Officer, JCOs/ORs and Family pensioners

Subject:- Revision of pension in respect of Pre-2006 Commissioned Officer, JCOs/ORs and Family pensioners.

Reference:-This office Circular No. 547, 548 dated 11.09.2015, Circular No. 549 dated 30.09.2015 and Circular No. 551 dated 28.12.2015.

Pension Disbursing Agencies are required to revise the pension of Commissioned Officer, JCOs/ORs pensioners and Family pensioners in terms of above cited Circulars. A doubt has been raised as to whether, while revising Disability Pension and War Injury Pension, Service Element is also required to be revised. In this connection, the following clarifications are issued.

Points to be taken into consideration while finalizing the 7th Pay Commission Report :-
The demand of the Staff Side to fix the minimum pay to that of Rs. 26,000/- has been completely rejected by the 7th CPC and has arbitrarily fixed the minimum pay as Rs. 18000/, The 7th CPC has mutilated the formula for fixing the minimum wage. The minimum wage recommended amounts to a meager increase of Rs. 2250 from the existing minimum pay of Rs. 7000 + 8750 (125 % DA as on 1.1.2016). From this minimum pay of Rs, 18000/-, as per the recommendation of the 7th CPC itself Rs. 1500/- will be recovered for CGEIGS and 10 % i. e Rs.1800/- will be recovered towards New Pension Scheme from the employees recruited after 1.1.2004 and 6% towards GPF contribution from the employees recruited prior to 1.1.2004 resulting in minus or a very meager  benefit for the low paid employees.

Rates of Income Tax as per Finance Act, 2015 – Financial Year 2015-16(AY 2016/17)

RATES OF INCOME-TAX AS PER FINANCE ACT, 2015: As per the Finance Act, 2015, income-tax is required to be deducted under Section 192 of the Act from income chargeable under the head “Salaries” for the financial year 2015-16 (i.e. Assessment Year 2016-17) at the following rates:

3. SECTION 192 OF THE INCOME-TAX ACT, 1961: BROAD SCHEME OF TAX DEDUCTION AT SOURCE FROM "SALARIES":

3.1 Method of Tax Calculation:

Every person who is responsible for paying any income chargeable under the head "Salaries" shall deduct income-tax on the estimated income of the assessee under the head "Salaries" for the financial year 2015-16. The income-tax is required to be calculated on the basis of the rates given above, subject to the provisions related to requirement to furnish PAN as per sec 206AA of the Act, and shall be deducted at the time of each payment. No tax, however, will be required to be deducted at source in any case unless the estimated salary income including the value of perquisites, for the financial year

5. COMPUTATION OF INCOME UNDER THE HEAD "SALARIES"

5.1 INCOME CHARGEABLE UNDER THE HEAD "SALARIES":


(1) The following income shall be chargeable to income-tax under the head "Salaries" :

(a) any salary due from an employer or a former employer to an assessee in the previous year, whether paid or not;
(b) any salary paid or allowed to him in the previous year by or on behalf of an employer or a former

5.2 DEFINITION OF “SALARY”, “PERQUISITE” AND “PROFIT IN LIEU OF SALARY” (SECTION 17):

5.2.1 "Salary" includes:-

i. wages, fees, commissions, perquisites, profits in lieu of, or, in addition to salary,
advance of salary, annuity or pension, gratuity, payments in respect of encashment of leave etc.
ii. the portion of the annual accretion to the balance at the credit of the employee participating in a recognized provident fund as consists of {Rule 6 of Part A of the Fourth Schedule of the Act}:

a) contributions made by the employer to the account of the employee in a
recognized provident fund in excess of 12% of the salary of the
employee, and

b) interest credited on the balance to the credit of the employee in so far as it is allowed at a rate exceeding such rate as may be fixed by Central Government. [w.e.f. 01-09-2010 rate is fixed at 9.5% - Notification No SO 1046(E) dated 13-05-2011]

Govt limits foreign travel by bureaucrats to 4 per year

New Delhi: Bureaucrats can go on a maximum four overseas trips in a year, according to a Finance Ministry guideline which says that Secretaries should undertake foreign travels only when no one else can be deputed.

Secretaries to Government departments have also been barred from travelling abroad during Parliament session unless absolutely unavoidable. Also, Secretary and the Minister of a department cannot be abroad at the same time.

HRD min receives 70 applications for IITD Director post

Nearly 70 applications from senior academicians have been received for the position of Director of Indian Institute of Technology (IIT) Delhi, as the Human Resource Development (HRD) ministry is working to fill several key positions in the higher education sector.
It is learnt that the ministry would, in a meeting later this month, vet the applications and shortlist eligible candidates following which a Search-cum-Selection Committee would make its recommendations, sources said.

The Ministry had invited applications for the position of IIT Director last year.

Trade unions seek doubling of I-T exemption limit to Rs 5 lakh

New Delhi: Trade unions have asked the government to increase the income tax exemption limit to Rs 5 lakh and the minimum wage to Rs 18,000 besides raising the minimum monthly pension to Rs 3,000 for all.
They also sought a special package for victims of the recent Tamil Nadu floods.

These demands were raised under a 15-point charter submitted by 11 central trade unions to Finance Minister Arun Jaitley during pre-Budget consultations held here. The Union Budget for the next financial year, 2016-17, is slated to be presented in Parliament in February end. It will take effect from April 1.

Civic body employees stage protest

New Delh - Thousands of civic body employees today staged a massive demonstration at the Civic Centre here demanding timely payment of salaries and unification of the three "financially-ill" municipal corporations.
"Thousands of employees from the three municipal corporations today abstained from work and staged demonstration at the headquarters of South and North Delhi Municipal corporations at Civic Centre," said Rajender Mewati, general secretary of United Front of MCD employees.

500-strong women troops commissioned into ITBP

A freshly-trained contingent of 500 women personnel, which will be the first 'mahila' squad to be deployed in high-altitude posts along the India-China border, was on Friday commissioned into the Indo-Tibetan Border Police (ITBP) in Panchkula.

The women, in the rank of constable, were inducted in the border-guarding force after 44-weeks of training in battle craft and mountain survival and will now be sent to frontier areas for final acclimatisation before being deployed at ITBP posts along the Sino-India Line of Actual Control (LAC).

Issue Swift I-T Refunds If Arrears Up To Rs 5,000: CBDT

New Delhi, Jan 15 (PTI) In a taxpayer friendly move, the government has directed Income Tax officials to issue refunds in cases where outstanding arrears are up to Rs 5,000 without any adjustment.

In an initiative to reduce taxpayer grievances and enhance the taxpayer satisfaction, the Central Board of Direct Taxes had issued instructions to Central Processing Centre (CPC) - Bengaluru and the field officers in December to issue refunds of amounts less than Rs 50,000 expeditiously.

New Rules On IAS, IPS Officers Transfer Creates Confusion

New Delhi, Jan 15 (PTI) The Centre has notified new rules to exclude ministers from a panel that decides on transfers of IAS and IPS officers in the joint cadre of some states, which was being seen as an attempt to keep out Aam Aadmi Party's ministers from it.

However, senior government officials denied it saying that the rules do not apply to joint cadre of union territories which include Delhi.

Centre Seeks Report On Discontinuation Of Govt Job Interviews

The decision to discontinue interview for recruitments is for all Group 'C' and non-gazetted posts of Group 'B' category and all such equivalent posts, the DoPT said.

All central government ministries have been asked to send a report, duly approved from their concerned ministers, to the Centre on discontinuation of interviews for junior level recruitments. They were earlier asked to send the report by last week.

The husband of an Aam Aadmi Party MLA was today arrested in connection with an incident in which a central government official was allegedly obstructed from discharging his duty and also assualted in a south Delhi area, police said.

On December 15, Delhi Police had registered a case based on a complaint by a CPWD official alleging that he was beaten up by several women at the behest of R K Puram legislator Parmila Tokas's husband, Dheeraj, and other party workers during an illegal slum removal drive in R K Puram Sector 12, a police official said.

Subject:- Central Civil Services (Leave Travel concession) Rules, 1988 – Fulfillment of Procedural requirements.

This Department is in receipt of a number of references regarding the procedural difficulties faced by the Government employees in application and settlement of the LTC claims. Sometimes, the Government servants claim that failure to follow the correct procedure was on account of a lack of knowledge of the rules/instructions while in the other cases the delay is caused in the late processing of LTC claims.

-प्रदेशभर के रोडवेज कर्मचारी शुरुआत से ही हरियाणा सरकार की नई परिवहन नीति का विरोध कर रहे हैं। अब उन्होंने नई परिवहन नीति के विरोध में रणनीति बनानी शुरू कर दी है।

अजमेर। राज्य सरकार ने राजस्थान लोक सेवा आयोग व राजस्थान अधीनस्थ एवं मंत्रालयिक सेवा चयन बोर्ड की ओर से आयोजित परीक्षाओं में नियुक्त अधिकारियों, कर्मचारियों एवं विषय विशषज्ञों के पारिश्रमिक, मानदेय एवं भत्तों में बढ़ोतरी की गई है। इस संबंध में आयोग को कार्मिक विभाग से सोमवार को आदेश प्राप्त हो गए हैं। आगामी परीक्षाओं से बढ़ी हुई दरों से ही भुगतान किया जाएगा।

आयोग की परीक्षा के केंद्राधीक्षक को एक दिन की दो पारी में सेवाएं देने के लिए भविष्य में 600 रुपए मिलेंगे, जबकि अभी 300 रुपए मिल रहे हैं। सहायक केंद्राधीक्षक को 250 रुपए के स्थान पर 400 रुपए मिलेंगे। पर्यवेक्षक (इनविजिलेटर) को 200 रुपए के स्थान पर 400 रुपए प्रतिदिन दो पारी में सेवाएं देने पर मिलेंगे। लिपिक को 120 रुपए के स्थान पर 200 रुपए मिलेंगे। चतुर्थ श्रेणी कर्मचारी को 75 रुपए की जगह 125 रुपए का भुगतान होगा।

डॉ. पंवार ने किया था मानदेय बढ़ोतरी का आग्रह
आयोग के अध्यक्ष का 10 अगस्त 2015 को कार्यभार संभालते ही डाॅ. ललित के. पंवार ने अधिकारियों, कर्मचारियों एवं विषय विशेषज्ञों को देय पारिश्रमिक एवं मानदेय की दरों को अपेक्षाकृत कम बताते हुए कहा कि वे राज्य सरकार से अनुरोध कर इसमें बढ़ोतरी कराने का प्रयास करेंगे। डाॅ. पंवार ने अपनी पहली पत्रकार वार्ता

OFFICE MEMORANDUM

Subject: – Procedure for empanelment of retired officers as the Inquiry Officers for conducting Departmental Inquiries– reg.

The undersigned is directed to state that the issue of utilizing the services of retired officers for conducting departmental inquiries had been under consideration of the Department. It has now been decided that panels of retired officers from the Ministries/Departments under Government of India and PSUs would be created and maintained by the respective Cadre Controlling Authorities for conducting Departmental Inquiries against the delinquent officials.
